Terms of Service

These Terms of Service ("Terms") govern your use of the OwOsy website (owosy.com), the OwOsy web dashboard (app.owosy.com), and OwOsy products, including the OwOsy Translate Framer plugin, web dashboard, and client-side translation widget (the "Service"), operated by Phinguin ("we," "us," or "our"). By using the Service or creating an account, you agree to these Terms and our Privacy Policy. These Terms apply to all users of the Service, including those on the free tier.

1. The Service

OwOsy Translate consists of the following components:

  • Framer Plugin: A configuration tool installed in the Framer editor. Used to select languages, customize the widget appearance, scan your published site, and trigger translations.
  • Web Dashboard: A web application at app.owosy.com for managing sites, configuring languages, scanning pages, and triggering translations. Available for all platforms (Carrd, Ghost, Webflow, and any site that supports custom code).
  • Translation API: A Cloudflare Worker that translates your page content using OpenAI's GPT-4o mini model and caches the results.
  • Client-Side Widget: A lightweight JavaScript widget (widget.js) that you embed on your published site via a script tag. The widget displays a language selector and swaps page text with cached translations for visitors.

2. Accounts and License Keys

  • To use the web dashboard, you must create an account with a valid email address. You may sign up via email/password or Google OAuth.
  • Free tier usage does not require a license key.
  • Paid plans require a valid license key obtained through Lemon Squeezy.
  • You are responsible for keeping your license key confidential. License keys should not be shared publicly or embedded in client-side code other than via our provided widget script.
  • One license key may not be shared across multiple organizations.
  • A unique site ID is generated per project and used to identify your widget configuration and cached translations.

3. Subscriptions and Billing

3.1 Auto-Renewal

All paid subscriptions automatically renew at the end of each billing period (monthly) at the then-current price, unless you cancel before the renewal date. You will be charged on the same date each month through Lemon Squeezy.

3.2 Pricing

Current pricing is displayed on our pricing page. We reserve the right to change pricing with 30 days' notice to existing subscribers. Price changes do not affect your current billing period.

3.3 Cancellation

You may cancel your subscription at any time through the Lemon Squeezy customer portal. Upon cancellation:

  • Your subscription remains active until the end of the current billing period.
  • You will not be charged again after cancellation.
  • Existing cached translations continue to serve for up to 90 days.
  • New translations cannot be generated after your subscription ends.
  • To fully remove the widget, delete the script tag from your site's custom code.
  • Glossary data will be deleted after your subscription expires.

3.4 Refunds

We offer a full refund within 14 days of your first subscription payment if you are unsatisfied with the Service. To request a refund, contact [email protected] with your subscription details. Refund requests are processed within 5 business days. Refunds after the 14-day period are provided at our discretion. No refunds are issued for partial months. EU/EEA consumers may have additional withdrawal rights under applicable consumer protection law.

4. Usage Limits

Each plan has limits on the number of target languages and words translated per month. These limits are enforced server-side. When you reach your limit:

  • Word limits reset at the beginning of each billing period.
  • Existing cached translations continue to serve regardless of usage limits (cached reads are free).
  • New translation requests are declined until the next billing period or an upgrade.
  • You may upgrade your plan at any time to increase limits.
  • If you exceed your word limit, new translations may continue for up to 7 days or until you reach twice your plan's word limit, whichever comes first. After that, new translations are blocked until the next billing period or an upgrade. Existing cached translations are never affected.

4.1 Fair Use Policy

Plans described as "unlimited" (including unlimited words and unlimited languages) are subject to a fair use policy. Fair use means usage that is reasonable for a single organization operating a typical website or portfolio of websites. Examples of usage that falls outside fair use include:

  • Automated or programmatic translation requests not initiated through the plugin or widget
  • Using a single license to serve translations for unrelated third-party websites
  • Sustained translation volumes that significantly exceed typical website usage patterns (e.g., translating millions of words per month)
  • Bulk-translating content for resale or redistribution

As a general guideline, usage above 500,000 words per month on Pro plans may be reviewed. If your usage exceeds what we consider fair, we will contact you to discuss your needs before taking any action. You may request a review of our determination or propose an upgraded arrangement. We reserve the right to throttle or suspend translation generation (not cached delivery) for accounts that exceed fair use. We will always give at least 14 days' notice before enforcing limits on an existing account.

4.2 Free Tier Badge

The free tier requires display of a "Translated by OwOsy" badge on the widget. Removing or hiding the badge on the free tier is a violation of these Terms. Paid plans may remove the badge.

5. Translation Disclaimer

OwOsy Translate uses machine learning (OpenAI's GPT-4o mini) to generate translations. Automatic translations may contain errors, inaccuracies, or inappropriate content.

  • Translations are provided "as is" without any guarantee of accuracy, completeness, or fitness for a particular purpose.
  • Automatic translation is not a substitute for professional human translation, especially for legal, medical, financial, or other regulated content.
  • You are responsible for reviewing the quality of translations displayed on your published site.
  • We strongly recommend using the glossary feature for critical terminology.

6. Your Content

  • You retain all ownership rights to your website content.
  • By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing translations.
  • Your content is transmitted to OpenAI for translation processing. See our Privacy Policy for details on third-party data processing.
  • Translated content is cached on our servers for delivery to your visitors. Cached translations are deleted after 90 days or upon account termination.
  • We do not use your content for any purpose other than providing the Service.

7. The Widget

  • The widget (widget.js) is served from our Cloudflare Worker infrastructure.
  • You are responsible for adding and removing the widget script tag from your site.
  • The widget does not collect personal information from your site's visitors.
  • We may update the widget code to fix bugs, improve performance, or add features. Updates are delivered automatically since the script is served from our servers.

8. Acceptable Use

You may not use the Service to:

  • Translate content that violates any applicable law or regulation
  • Circumvent usage limits through automated means, multiple accounts, or license key sharing
  • Remove or hide the "Translated by OwOsy" badge on the free tier
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with or disrupt the Service's infrastructure
  • Resell the Service or its output without authorization

9. Intellectual Property

  • The OwOsy name, logo, and branding are the property of Phinguin.
  • The Service (code, design, documentation) is the property of Phinguin.
  • Translations generated by the Service belong to you.

10. Third-Party Services

The Service relies on third-party services including:

We are not responsible for the availability, performance, or terms of third-party services.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not warrant that translations will be accurate, complete, or error-free.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for damages arising from inaccurate translations, including but not limited to loss of business, reputational harm, or regulatory penalties.

Nothing in these Terms excludes or limits our liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded or limited by applicable law.

12. Indemnification

You agree to indemnify and hold harmless Phinguin and its employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your publication of automatically generated translations.

13. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Upon termination for a Terms violation, your license key will be deactivated and cached translations will be deleted immediately. This is distinct from voluntary cancellation (Section 3.3), where cached translations continue to serve for up to 90 days. To remove the widget from your site, delete the script tag from your site's custom code.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Where required by applicable law, we will seek your affirmative acceptance of material changes.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the competent courts of the State of Georgia. If you are an EU consumer, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory consumer rights.
